1. Operator
MYQRAD is operated by Assist Control S.R.L., Bucharest, Romania. References to “MYQRAD”, “we”, “us” or “our” in these Terms refer to Assist Control S.R.L. as operator of the service.
2. Acceptance and scope
By creating an account, purchasing or using a plan, or otherwise using MYQRAD, you agree to these Terms and the Privacy Policy. If you use MYQRAD for an organisation, you confirm that you are authorised to act for that organisation.
If mandatory law gives you rights that cannot be excluded or limited by contract, those rights remain unaffected.
3. Eligibility and accounts
You must be at least 18 years old and legally capable of entering into an agreement. Registration information must be accurate and kept current.
You are responsible for maintaining the confidentiality of your login credentials and for activity carried out through your account. You must not use another customer’s account without authorisation or create a false identity for the purpose of accessing the service.
We may require email verification or other reasonable account checks before access to particular functions is granted.
4. MYQRAD service
MYQRAD provides infrastructure for creating and managing dynamic QR campaigns and related destination experiences. Depending on product availability and plan, functionality may include campaign editing, publishing, analytics, appointments, lead collection, billing features, agency-oriented Layers, and other campaign tools.
Features may change as the product develops. A feature shown in documentation or on a roadmap is not guaranteed to be available until it is released for customer use.
5. Acceptable use
You must use MYQRAD lawfully and responsibly. You must not:
- use the service for unlawful, fraudulent, deceptive, abusive or harmful activity;
- upload or distribute malware, malicious code or content designed to compromise systems or users;
- attempt to bypass access controls, probe non-public systems, interfere with service operation or obtain another customer’s data;
- use MYQRAD to infringe intellectual-property, privacy, publicity or other legal rights;
- misrepresent a QR destination, impersonate another person or organisation, or use a campaign to mislead scanners about who operates it;
- use automated methods in a manner that creates unreasonable load or disrupts normal service operation.
6. Customer content and campaign responsibility
You retain responsibility for the text, images, files, destinations, forms, offers and other material you add to a MYQRAD campaign. You must have the rights and permissions needed to publish that material.
You are also responsible for notices, consents and legal disclosures required by the content or data-collection functions you enable in your campaigns.
Links and destinations outside MYQRAD may be controlled by third parties. We are not responsible for third-party content, availability or practices solely because a MYQRAD campaign links to them.
7. Plans, billing, cancellation and refunds
Where paid plans are offered, the price, billing interval, included features and applicable taxes are shown at purchase or in the account area. You authorise charges using the payment method selected for the subscription.
Recurring subscriptions continue until cancelled or otherwise ended under the applicable plan terms. Cancellation stops future renewal but does not automatically reverse charges already incurred.
Refunds, credits, withdrawal rights and cancellation consequences are subject to the plan terms shown at purchase and to mandatory Romanian or European Union consumer law where applicable. Nothing in these Terms removes a statutory right that cannot lawfully be waived.
8. Availability, changes and maintenance
We aim to keep MYQRAD available and functional, but no online service can be guaranteed to operate without interruption. Maintenance, security work, third-party outages, technical failures or events outside reasonable control may affect availability.
We may modify, replace, suspend or discontinue functionality where reasonably necessary for security, technical, legal or product reasons. Where a material change affects an active paid service, we will provide notice where required by applicable law or the relevant subscription terms.
9. Intellectual property
MYQRAD software, interfaces, branding, documentation and other service materials are owned by or licensed to Assist Control S.R.L. and are protected by applicable intellectual-property laws.
Your right to use the service is limited to the access granted by your account and plan. You may not copy, sell, sublicense, reverse engineer or create unauthorised derivative services from protected MYQRAD software except to the extent such restriction is prohibited by mandatory law.
10. Suspension and termination
You may stop using the service and may cancel an eligible subscription through the available account process. We may suspend or terminate access where an account is used in material breach of these Terms, presents a security risk, remains unpaid where payment is required, or where suspension is otherwise reasonably necessary to protect the service, customers or third parties.
Sections that by their nature should survive termination — including intellectual-property, payment obligations already incurred, liability provisions and governing law — remain effective after termination.
11. Privacy and data protection
Personal data is handled in accordance with the MYQRAD Privacy Policy and applicable data-protection law. Customers using MYQRAD to collect personal data from their own scanners or end users are responsible for determining and meeting their own legal obligations for that collection.
12. Disclaimers and limitation of liability
MYQRAD is provided with the functionality made available at the time of use. To the maximum extent permitted by law, we do not guarantee that every feature will be uninterrupted, error-free or suitable for every specific business purpose.
To the maximum extent permitted by applicable law, Assist Control S.R.L. is not liable for indirect or consequential losses arising solely from interruption, third-party destinations, customer-provided content, or use of the service contrary to these Terms.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including mandatory consumer protections where they apply.
13. Changes to these Terms
We may update these Terms to reflect product, legal, security or operational changes. The current version is published on this page with its update date. Where applicable law requires additional notice or consent for a material change, we will provide it.
14. Governing law and jurisdiction
These Terms are governed by the laws of Romania and the applicable law of the European Union.
Subject to mandatory rules that provide otherwise, disputes relating to MYQRAD or these Terms fall within the jurisdiction of the competent courts of Bucharest, Romania. If you are a consumer, mandatory rights relating to the courts or law of your country of residence remain unaffected where European Union law provides those rights.
15. Customer contact
MYQRAD does not publish a support mailbox. Verified customers can use the protected Customer Contact page. The contact form is made available only after account details are verified against the MYQRAD customer database.
